Privacy Policy

1. Who is responsible for your data

The party responsible for processing the personal data collected on this site is COMERCIAL Y SERVICIOS PROSPECTIVA LIMITADA, RUT 76.026.797-K, owner of the Omnifunk platform.

2. What data we collect

This site collects personal data through the form on the contact page. The fields are:

Omnifunk service you're interested in.
Your organization's industry.
Name.
Email address.
Phone number.
An optional free-text message about your operation.

In addition, the server that hosts this site logs the technical data typical of any internet connection (IP address, date and time of access, browser type, and pages visited), which we use only to run and protect the site.

This site uses Google Analytics to understand how the site is used (pages visited, time on site, traffic source), in aggregate form and without identifying you directly. We don't use advertising pixels or behavioral profiling, and we don't ask for sensitive data: please don't include it in the free-text field of the form.

3. What we use your data for

Answering your inquiry and contacting you through the channel you indicated.
Preparing a technical or commercial proposal when you request one.
Following up on the request you submitted.
Meeting legal and accounting obligations when applicable.
Understanding how the site is used, through Google Analytics, to improve it.

We don't use your data for mass marketing, or for purposes other than the ones above, without your prior consent.

4. What legal basis we rely on

We process your data with your consent, which you give by submitting the form, and to manage the stage that precedes a possible business relationship that you initiated yourself. You can withdraw your consent at any time by writing to us, with no retroactive effect on processing already carried out.

5. Who we share it with

We don't sell, rent, or transfer your personal data to third parties for their own commercial purposes.

Only the people in our organization who need it to handle your inquiry have access to it, along with the providers who deliver our hosting, email, and analytics services (Google Analytics), who act on our behalf, under our instructions, and with confidentiality obligations.

6. Where it's stored

Form data is stored on infrastructure located in Chile. The aggregate browsing data processed by Google Analytics is handled under Google's terms. If that changes for the form data, we'll update this policy and adopt whatever safeguards the law requires before doing so.

7. How long we keep it

If your inquiry doesn't lead to a business relationship, we keep your contact data for up to 24 months from the last contact between us, then delete or anonymize it.
If a business relationship is established, we keep the data for as long as that relationship is active.
Once the relationship ends, we keep only the records the law requires us to retain (accounting, tax, and commercial documentation) for the applicable legal periods, which in Chile can run up to six years.
You can ask us to delete your data at any time, and we will, except for anything we're legally required to keep.

8. Your rights

Regarding your personal data, you can exercise the rights of access, rectification, deletion, objection, blocking, and portability, and request information about how we process it.

To exercise these rights, write to contacto@omnifunk.cl with your name, the right you want to exercise, and a way to reach you. We'll respond within the periods set by law. If you're not satisfied with our response, you can file a complaint with the competent personal data protection authority in Chile.

9. Security

We apply reasonable technical and organizational measures to protect your data: an encrypted connection to the site, restricted access to the inboxes and systems where forms arrive, and control over who is authorized to access them. No system is foolproof, and if an incident materially affecting your personal data were to occur, we'll notify you along with the measures we took.

10. Minors

This site is directed at organizations and individuals acting in a professional capacity. It isn't intended for minors, and we don't knowingly collect data from minors.

11. Changes to this policy

We may update this policy as our practices, the site, or applicable regulations change. The version in effect is always the one published on this page, with its effective date at the top. If a change is material and affects data you already gave us, we'll let you know through the contact channel we have on file.

12. Applicable law

This policy is governed by Chilean law on privacy and personal data protection, and by any other applicable rules.
